For the fees quoted to you we will provide you with either a simple Will with an outright gift of your residuary estate or a more complex Will including a nil rate band discretionary trust and an outright gift of your residuary estate. The fees quoted will entitle you to:

Name the people (known as executors and trustees) who will carry out the instructions set out in your Will.

Appoint guardians for your minor children.

Include a request to be buried or cremated.

Make specific gifts of your chattels (no more than four individual bequests).

Make up to six gifts of money to adults outright, to minors where their parent/guardian can give valid receipt for the gift, or a combination of such gifts.

Make up to four gifts of money to charities, if you provide us with the addresses and registered charity number.

In the more complex Will, to include standard provisions in relation to a nil rate band discretionary trust.

Give your residuary estate (which is what is left after paying any specific legacies given by you in your Will, any taxes, your debts and funeral expenses and the costs of administering your estate) in one of the following ways:

(a)

Outright to one person (e.g your spouse) and if that person dies before you then to such of their children as survive you and if more than one in equal shares. You can provide that the children have to reach a specified age (18, 21 or 25) to inherit their share and you can provide that if any of them dies before you leaving children who reach a specified age those children shall (and if more than one in equal shares) take their deceased parent’s share of your estate.

(b)

Outright to two or more people in equal shares (up to four individuals or a class of people e.g your children) with the terms of the gift relating to each person being identical, for example, a gift of your residuary estate to such of your children as survive you and if more than one in equal shares. You can provide that they have to reach a specified age (18, 21 or 25) to inherit their share and you can provide that if any of them dies before you leaving children who reach a specified age those children shall (and if more than one in equal shares) take their deceased parent’s share of your estate.

(c)

Outright to up to four charities in equal shares, if you provide us with the addresses and registered charity numbers.

By “outright” we mean that the beneficiary (or beneficiaries) will get the assets of your residuary estate, not just the right to receive the income from those assets.

Make provision for a longstop gift should the gift of your residuary estate fail. The options available for your longstop gift are as in 8 above.
